Terms and Conditions for the Provision of Services

1. Definitions

For the purposes of these Terms and Conditions, the following definitions shall apply:

  1. TERMS AND CONDITIONS – these provisions governing the provision of accounting advisory services.
  2. ADVISORY SERVICES – all activities related to advising and supporting the Client in the field of accounting services.
  3. SERVICE PROVIDER – Dariusz Lockau, Wilmersdorfer Str. 142, 10585 Berlin, Germany.
  4. CLIENT – a natural or legal person ordering a service.
  5. PARTICIPANT – the Client or a person appointed by the Client to participate in a consultation.
  6. AGREEMENT – an agreement concluded between the Client and the Service Provider subject to at least three necessary conditions: the Client's acknowledgement of and acceptance of these Terms and Conditions, payment for the Service when booking the appointment, and agreement on the logistical details of the Service, including the date and method of the meeting accepted by both parties (at the office at Wilmersdorfer Str. 142, 10585 Berlin or by video conference).

2. General Provisions

  1. These Terms and Conditions set out the rules for the provision of advisory services, the conditions for booking consultations and the complaint procedure.
  2. The Service Provider is Dariusz Lockau, Wilmersdorfer Str. 142, 10585 Berlin, Germany.
  3. The Service Provider is the controller of personal data processed in connection with the implementation of these Terms and Conditions. Providing personal data is voluntary.

3. Cooperation and Payment Terms

  1. Once a consultation date, hereinafter referred to as the Service, has been agreed, an invoice will be issued. The appointment is guaranteed once the Service has been paid for in advance, no later than the day before the Service begins.
  2. By accepting the Service Provider's offer and making payment, the Client accepts the following rules and conditions for cancelling the Service and receiving a refund: a) no later than 21 calendar days before the agreed date – the Client is entitled to a full refund of the amount paid; b) no later than 7 calendar days before the agreed date – the Client is entitled to a refund of half of the amount paid; c) less than 7 calendar days before the agreed date – the Client is not entitled to a refund of the amount paid.
  3. The reasons for cancelling the ordered Service or changing its date do not affect the rules set out in point 2.
  4. Amounts retained due to the cancellation of a scheduled Service constitute remuneration for the Service Provider for remaining available to provide the Service on the originally agreed date.
  5. Any adjustments to the remuneration due and any additional costs will be documented by the appropriate accounting documents.
  6. The Client is entitled to a full refund of the amount paid if: a) the Service Provider cancels the Service, b) the Service Provider proposes a change to the Service date and the Client does not accept the proposed date.
  7. Communication concerning the cancellation or change of Service dates must be made by e-mail or telephone to be valid.

4. Obligations of the Parties

  1. The Service Provider undertakes to provide the Services with the highest level of care and to always act in the best interests of the Client.
  2. The Service Provider is responsible for providing practical advice aimed at resolving the Client's problems in the area of tax services. Where necessary, the Service Provider's qualifications may be confirmed by appropriate documentation.
  3. The Client undertakes to pay the Service Provider for the Service under the terms set out in these Terms and Conditions and in accordance with the agreed details.

5. Complaints Procedure

  1. Every Client has the right to submit a complaint concerning Advisory Services within 30 business days from the date on which the Service was provided.
  2. Complaints concerning Advisory Services must be submitted in writing by registered mail to the Service Provider's address specified in these Terms and Conditions (§1 point 3), or electronically by sending the complaint to info@ksiegowy.de.
  3. A complaint should contain: a) the Client's first and last name or company name, b) the Client's registered address, c) the subject of the complaint (name of the Service, date and place of performance, first and last name of the employee conducting the consultation), d) the substantive and formal grounds for the complaint, e) the Client's expectations towards the Service Provider.
  4. The complaint will be considered within 30 business days from the date it is received by the Service Provider. In cases requiring additional investigation, the processing time may be extended.
  5. After receiving a complaint electronically, the Service Provider will confirm receipt by return e-mail.
  6. The Service Provider reserves the right not to consider a complaint if it is submitted after the deadline specified in point 1 of this section or if it results from a lack of knowledge of these Terms and Conditions.
  7. If the complaint does not contain all the information specified in point 3 of this section, the Service Provider will give the Client seven days to submit a corrected complaint.

6. Final Provisions

  1. The Service Provider may ask the Client to complete an anonymous paper questionnaire to evaluate the consultation provided.
  2. The Privacy Policy available at www.ksiegowy.de/polityka-prywatnosci forms an integral part of these Terms and Conditions.
  3. These Terms and Conditions enter into force on the date of their publication on the Service Provider's website and remain in force for an indefinite period.
  4. Any disputes arising between the Service Provider and the Client in connection with these Terms and Conditions shall first be resolved through amicable negotiations. If no agreement can be reached, disputes shall be resolved by the court having jurisdiction over the registered office of the Service Provider.
  5. Matters not covered by these Terms and Conditions shall be governed by the provisions of the Civil Code.
  6. The Service Provider reserves the right to amend these Terms and Conditions. Amendments shall enter into force seven calendar days after their publication on the Website.
